These Terms and Conditions ("Terms") govern your access to and use of the website located at miraclemistinc.com (the "Site") and any purchase of products offered through the Site. The Site is operated by Miracle Mist Inc. ("Miracle Mist," "we," "us," or "our"), the parent company of the Something's Fishy, Odonix, and Something's Buggin brands.
By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or purchase our products.
1. ELIGIBILITY AND ACCEPTANCE
1.1 You must be at least 18 years of age, or the age of majority in your jurisdiction, to make a purchase on the Site. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete.
1.2 Certain products sold on the Site, including knives and bladed cutlery, are subject to additional age and legal restrictions. You are responsible for confirming that you are legally permitted to purchase, own, and possess any such product in your state, county, and city before placing an order. We reserve the right to refuse or cancel any order for a bladed product that we believe may violate applicable law.
1.3 We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
2. PRODUCTS AND DESCRIPTIONS
2.1 We offer a range of products that may include all-natural deodorizers and anti-microbial sprays, insect repellents, apparel, and handmade Damascus cutlery. We make every effort to display product descriptions, colors, and images as accurately as possible. We do not warrant that product descriptions, pricing, or other content on the Site is complete, current, or error free.
2.2 Handmade items, including cutlery, may vary slightly in appearance, pattern, and finish from the images shown. These variations are a natural characteristic of handmade goods and are not considered defects.
2.3 Our natural and plant-based products are intended for their stated purpose only. You should read all product labels, directions, and warnings before use. Statements regarding our products have not been evaluated by the U.S. Food and Drug Administration unless expressly stated, and our products are not intended to diagnose, treat, cure, or prevent any disease. If you have a known sensitivity or allergy, discontinue use and consult a medical professional if needed.
2.4 All products are subject to availability. We reserve the right to discontinue any product or limit the quantity of any product offered at any time.
3. PRICING AND PAYMENT
3.1 All prices are listed in U.S. Dollars (USD) unless otherwise stated. Prices are subject to change without notice.
3.2 We accept the payment methods displayed at checkout, which may include major credit cards, Apple Pay, Google Pay, PayPal, Shop Pay, ACH Direct Debit, USDC, and others. By submitting payment information, you represent that you are authorized to use the chosen payment method.
3.3 You are responsible for any applicable sales tax, duties, or other charges associated with your order. These amounts will be calculated and displayed where required at checkout.
3.4 In the event a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any order placed for that product, whether or not the order has been confirmed and payment processed.
4. ORDERS AND ORDER ACCEPTANCE
4.1 Your submission of an order constitutes an offer to purchase. All orders are subject to our acceptance. We may, at our discretion, decline or cancel any order for reasons that include but are not limited to product unavailability, errors in pricing or product information, or suspected fraudulent or unauthorized activity.
4.2 An order confirmation email acknowledges that we have received your order. It does not constitute our acceptance of the order or guarantee that products will be shipped.
4.3 If we cancel an order after payment has been processed, we will issue a refund to your original payment method.
4.4 Orders are typically processed within 1-3 business days after payment is received. Orders placed on weekends or holidays will be processed on the next business day.
5. SHIPPING AND DELIVERY
5.1 Shipping options, costs, and estimated delivery times are described on our Shipping Policy page and presented at checkout. Delivery time frames are estimates only and are not guaranteed. Standard delivery time is typically 3-7 business days after shipment depending on the carrier and destination.
5.2 Risk of loss and title for products pass to you upon our delivery of the products to the carrier. We are not responsible for delays, loss, or damage caused by the carrier once an order has shipped.
5.3 You are responsible for providing a complete and accurate shipping address. We are not liable for orders shipped to an incorrect address provided by you.
5.4 Once your order has been processed, the tracking information will be sent to the email address provided during checkout.
5.5 We currently ship within the United States only.
5.6 If your package arrives damaged or appears lost in transit, please contact us within 7 days of the delivery date or expected delivery date so we can assist you.
6. RETURNS AND REFUNDS
6.1 Returns, exchanges, and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. Please review that policy before making a purchase. We accept returns within 10 days of delivery for unused products in resellable condition. Original shipping charges are non-refundable.
6.2 Certain items, including those that are used, opened, or made to order, may not be eligible for return. Bladed products may carry additional return restrictions for safety and legal reasons. Please contact us within 7 days of delivery with your order number and photos of the issue so we can help resolve it.
6.3 Proof of purchase or order confirmation is required for all returns. Once your return is received and inspected, approved refunds will be issued to the original payment method within 5-10 business days.
6.4 Customers are responsible for return shipping costs unless the item arrived damaged, defective, or incorrect due to our error.
7. INTELLECTUAL PROPERTY
7.1 All content on the Site, including text, graphics, logos, product images, brand names such as Miracle Mist, Something's Fishy, Odonix, and Something's Buggin, designs, and software, is the property of Miracle Mist Inc. or its licensors and is protected by United States and international intellectual property laws.
7.2 You may not copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written permission. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.
